Approval of an estimate, proposal, invoice, or order from Midwest Stone constitutes acceptance of the terms and conditions listed below.

Purchase & Delivery Terms

  1. Customer Responsibility: All materials are sold to the Customer listed on the estimate or invoice. The Customer is responsible for payment regardless of whether materials are billed to an individual, company, or third party.
  2. Pricing & Taxes: Pricing is subject to change without notice until accepted. Freight, taxes, and applicable fees will be added unless otherwise noted. Any applicable sales or use tax is the responsibility of the Customer unless a valid exemption certificate is provided.
  3. Estimated Quantities: Material quantities are based on plans, elevations, or takeoffs and are estimates only. Final quantities may vary and are subject to field verification. Midwest Stone is not responsible for shortages or overages resulting from plan discrepancies or site conditions.
  4. Special Orders: All special-order materials are final sale and cannot be canceled, returned, or exchanged once ordered.
  5. Returns & Cancellations: Returns are not accepted on any materials once they have been picked up, delivered, or installed.
  6. Inspection of Materials: Customer agrees to inspect all materials upon pickup or delivery and must notify Midwest Stone of any damage, shortages, or defects within 48 hours. After that time, materials are considered accepted.
  7. Material Use: Use of materials constitutes acceptance of product condition and waives any claims related to visible defects, shipment errors, or product discrepancies.
  8. Application & Installation: Midwest Stone is not responsible for installation methods unless contracted to install. Proper installation practices and compliance with local building codes are the responsibility of the installer or purchaser.
  9. Exterior Applications: Certain applications, including dry-stack or non-grouted stone, may not be recommended in this region due to climate conditions. Midwest Stone is not responsible for performance of materials installed against recommendations.
  10. Moisture Management: Proper drainage, flashing, and moisture control systems are required for all installations and are the responsibility of the installer.
  11. Ownership of Materials: All materials remain the property of Midwest Stone until paid in full.

Warranty

All materials are subject only to the manufacturer’s warranty, if applicable. Midwest Stone does not provide additional warranties beyond those offered by the manufacturer.

Materials are sold “as is” without any implied warranties, including but not limited to merchantability or fitness for a particular purpose.

Midwest Stone is not liable for any indirect, incidental, or consequential damages related to material use, delays, or installation.
